just for the record.... (only bought from said retailer a couple of times...)

my 5870 was randomly crashing.... got in touch with XFX .. they always responded the next day.... recommend RMA ... got in touch with company for RMA (it was the time of the snow so no people could get in apparently...) - got RMA numbers after ringing... sent the card back by myself (RMSD) - not their courier - so my expense... got offered a refund or replacement card..... after about a week I got a bit itchy about maybe getting a 2nd hand card back ... so I emailed them and said I would indeed like the refund..... ordered a Sapphire ...... Refund came couple of days later..... just my 2p so got a decent result in the end.

Hope you get what you want in the end mate :)

XFX seemed decent via email.
 
I bet when a customer agrees to the 2nd hand refund, the vendor has the item back and RMA's it to the manufacturer and gets a brand new equal or better card to sell for full price again. What they call a "generous offer" I call "FRAUD".
 
omg cant believe the problems your havin its a complete joke...bought there a few times in the past no way anymore even if teh last time was a few years ago...panicked for a minute then on xfx until i read how they are trying to help you now lol
 
If I buy a XFX card then sell it a few months later, can I pass the warranty onto the new owner?

How would it work with the original retailer?
 
looks like that retailers lost a few customers, was looking to get my mobo there as they'r offering the best price... il go elsewhere now
 
I can see it now: over a dozen PC gamers with picket signs marching back and forth outside their store chanting, "Hey, ho, don't shop here! No! No!" over and over, hehe.
 
I have heard a fair number of negative comments about the e-tailer in question so I am not that surprised. Really hope he gets a fair result in the end. :)

i do hope you get what you want from them as i have purchased many items from them as well but i do hope none of them go wrong now.

this could be a good reference for anyone wanting what you want from them.

Hm I've had to RMA my ATI 4850x2 to them last week. Product of EOL and got offered ATI 5770 1gb card.. Wished I had'n accepted that offer now ! It really does not seem to perform the same as the old card.

Do you have any sort of cooling off period? It doesn't sound like they are the sort of company that would be helpful if you contacted them and said you are not happy.
 
Goods are required to live for a reasonable lifespan under the sales of goods act 1979, which this etailer is bound by. As 12 months is not a reasonable lifespan for a premium product with a two year warranty, they have sold you goods unfit for purpose and are liable to replace or repair said goods. They can make an offer based on the use you have got out of the card, but it must be one which an informed, reasonable person would accept.

As their suggestion is not a reasonable one, they are in breach of contract, and likely to fold if you cite legislation at them. Bloody con artists.

Don't suppose you bought it on a credit card did you? If so you can probably get a refund through your bank, which will then go after scan to cover their costs. Banks are scarier people to be chased by than customers.

Theyre completely ignoring the fact that xfx state that a "comparable equivalent should be offered". Seems theyve tried this on a few people whove posted in this thread. Probably in the hope that the customer will accept what they say and forget about it.
 
Which will often be the case. Most people fume for a while, tell people not to buy from them, then forget about it. There's always the odd one or two who suspect foul play then track down a law student / family friend though in which case "exceptions" are often made.

Stick with this one and you'll come out on top. It's important to bear in mind that shockingly thick, unqualified and ignorant people occasionally find themselves handling rmas, but behind them there will be a manager who pays attention to "breach of contract".

I presume you will no longer be buying from them? I tend to leave etailers after they screw me over.
