The wing is obvious legal otherwise it wouldn't have passed scrutineers for the past however many races .

Not at all, the rules say excess flex is not permitted and that the scrutirnering tests can be changed at any time, if anyone is suspected of having to much flex.

Considering those rules it is clearly illegal.

Indeed. I suspect we'll see Todt introducing a stricter test for the next race, having a chat with Red Bull and a stiffer wing appearing for the rest of season without any penalties being applied.

Like the Lotus 88, Brabham Fan Car, Renault mass damper, McLarens 3rd pedal, Ferrari tongue, two way telemetry, CVT gearbox - all legal according to the rules.
