An executive at an insurance broker specialising in the media industry suggested that the BBC may have ensured that Clarkson would be liable for any loss of its earnings from Top Gear. It was common for broadcasters to insure against the loss of production expenses when a celebrity goes “rogue”. Edel Ryan, of JLT Speciality, said: “Broadcasters have to consider the options available to them to protect their liability in this area.”

I'm not really sure that is how it works. I work in insurance but admittedly not a 'media specialist' but I can not see how JC is liable. As far as I am aware filming has been done and it has been the BBC's decision to not show the programme.

Then comes actually trying to recoup damages from JC. So the insurer pays the losses to the BBC (if they have cover in place) then the insurer subrogates against JC? On what grounds?

Think Edel was after some air time. Or the paper has just not understood what she was saying.

Punching a produced is doubtless considered gross misconduct.

2 things. 1) he didn't actually punch anyone.

2) It was still the BBC's decision to cancel the show. The show could have aired even if JC punched someone.

So maybe the insurance policy(ies) respond to the loss of earnings and/or payouts for breach of contract overseas, which would be pretty standard, but for them to go after JC is where it gets confusing.

Personally I don't care I have no doubt murdoch will offer his old buddy a job anyway.

If it was a punch it would be gross misconduct. If it was just a hissy fit of course they are going to investigate it before doing anything about it hence why people are more likely to believe the eyewitnesses saying there was no punch.
