Actually, it's true.

Try visiting the place and visit some of the smaller cities there. Then you'll see the very thing I have been describing.

Do bear in mind that if a motorist hits a pedestrian ON a pedestrian crossing, i have absolutely no doubts in my mind what the judge will say. Even if the idiot jumped out from the roadside, the motorist didnt apply "due care and attention".
You WILL get done if you hit a pedestrian on a crossing regardless of their lemming tendencies. You shouldnt have been going so fast if you noticed pedestrians OR if the enviroment made it difficult to spot potential pedestrians.

Getting out of your car was quite stupid. Like some above mentioned, the guy could have been looking for a fight, only to have his mates appear from nowhere to give you a kicking, or for him to slip one in your ribs/gut.

You won this fight, but in the future you could end up dead.

:confused: I'd like to know of the places you've "visited", I'm half South American and have spent a fair chunk of my life in countries there, so educate me as to where the law says you have the right if you're in a vehicle...

I didn't say the "law says you have a right". In some places in Brazil, for example, people assume that being in a car = having ultimate right of way.

Maybe I should have been clearer in my first post?

so we've got criminal damage against... assault! you make me laugh, all high and mighty on things like drugs (for example) but then potentially doing somebody some serious damage over a KEYED CAR and you say it's ok. pathetic.

If one were indeed at 5mph, then one would have no problem stopping safely. I seriously doubt anyone going at 5mph (that is walking pace). It would be more like 10-15, which can be "fast" in certain conditions.

As has been pointed out already in this thread, diminished responsibility can only be used in defence to reduce a charge of murder to manslaughter... and in the case of self defence, he was in a position to drive off and report the crime, he has not at any point mentioned whether the guy tried to attack him when he got out of the car, but by his explanation of events, the guy didn't have a chance to do much before he was struck to the ground!

It might have been easier. Unfortunately you get the same attitude in certain people everywhere, you can certainly see it on the roads here at times. It's all good and fun until someone gets hurt in a vehicle related (caused) accident, at which point the driver is screwed in most places.

He deserved a smack cause he got angry when you complained about his stupidity. If I'd have done the same I would put my hand up and admit I wasn't watching where I was going.

so you don't give the pedestrian his LEGAL right of way,
he's ****** off at this and keys your car, yes this IS a bad move, but you should have taken his reg number of HIS car and phoned the police.
you then ASSAULT him infront of the store (with people watching) and think that YOU are still in the right?

a) you arse, if your going to deck someone you wait till theres no-one looking
b) you where in the wrong IN THE FIRST INCIDENT. everything after this could be classed as "Agrovated".

c) I hate people like you. THE LAW STATES THAT YOU SHOULD STOP AT ZEBRA CROSSINGS, you should ALSO always drive AS IF YOU HAVE TO STOP EVEN IF THERE IS NO-ONE THERE YET.

I was out in town with my brother and his new baby boy a few days back and as we where crossing at a zebra crossing in town some PLANK like you drove across infront of us AS WE WHERE CROSSING.
people like you should never have been alowed to have a bleeding driving licence, you disgust me.

also, your thread tital says "HAD TO" you didn't HAVE to, you just lack the self control most of the rest of us have in place to stop us doing these things, maybe you should grow up.
