A non-disclosure agreement is not the same as an illegal bribe, but on you go. They are totally legally enforceable.

See, if it were about crime and punishment, it would go through the courts. That way, no proof results in no conviction and Spacey's reputation wouldn't be damaged... or he could perhaps sue for those damages if it went public.
