legal action against retailer?

Yup.

The gunsmith and shop who wrote the report have asked me if I am willing to let them have a go with the supplier.

I have the report and could now get this through the CC company but they said they might have a bit more clout with the supplier, who funnily enough, are now willing to take another look at the rifle under warranty.

Basically I am going to give it another chance, maybe against my better judgement, but keep the report and use the section 75 as a backup if things go wrong. I droped the rifle off today.

Turns out the gunsmith knows my inlaws and sister inlaw they used to go to school together so I dont think this guy is trying anything funny, and have not charged me for anything.

I guess the section 75 isnt 100% guaranteed so if I can get this sorted via other means that is probably best, otherwise I have the section 75 as a fallback.

Might crack a beer tonight!

I got the gun back on Saturday, the other place tried to sort it for me, although its a little better, still doesnt work properly, it'll fire maybe 8 in the magazine, but if you try and put 10 in it'll jam almost without fail. They only charged me £60 for all the messing about they had to do plus the report they provided, absolute legends, the fact that they went out of their way to try and help me and it wasn't even their responsibility just shows. I got the £60 back on the claim anyway, so cost me nothing.

It's been a LOOOOOONG road, but finally victory.

I do have a question, does anyone know if Newday will now be going after the money from the original vendor, or do a charge back etc? I assume Newday doesnt just swallow that cost?

I believe the vendor (shop?) will have the money taken from them.
They may well want the gun back themselves in order to trigger a claim back against the manufacturer (supplier if not direct).

Ok see what happens.

Just down the range now it's actually working better than it did although not perfect.

Hopefully they don't ask for it back.
