Yes it's charged and no response, the pad just flashes the lights on the underside like it's not paired.

There are so many apologists in this thread! The scratches incurred from inserting the Switch into the dock is an obvious oversight on Nintendo's part! There's a 50+ page thread over on Neogaf right now, and people have reported scratches on the bezel and screen despite being careful when docking the console. Many have resorted to novel solutions such as using felt pads etc.
You'll note that at the beginning of the thread, people were very dubious, even going so far as to accuse the OP of purposefully causing the scratches. People very quickly realised it was an issue, however. Many docks were bent out of shape right out the box!
It gets choppy at times in long grass but it happens rarely so I'm not too bothered by it. It happens on every console and probably always will - for example I played Everybody's Gone to The Rapture (PS4) on Friday whilst waiting for my delivery and the performance was pretty bad at times, but I still enjoyed the game. It'll be interesting to see how games hold up that were designed specifically for the Switch and not the Wii U.
Mine fits very tightly into the dock. There is visible bowing to the piece of plastic in the dock that the screen would come into contact with.

This is from carefully docking and undocking the system a few times. I can't be 100% sure something else didn't cause it, because I didn't notice it until later. It is only visible in direct bright light, but it definitely has me worried.
It gets more than choppy, I've had 3 second complete freezes.
Granted I was fighting in grass, in a rain storm with a weapon that freezes the monster, but still any time of 0 fps is bad.
