Oscar Pistorius thread

You don't fire off four rounds through a door with someone on the other side and accidentally hit them though do you?

He intended to kill whoever was on the other side of the door. The only thing in question was whether he knew it was her or not.

But in South Africa it's not unlawful to kill an intruder.

I was wondering about that. Does that mean that he could walk away despite killing someone (regardless of circumstances)?

Yes, of course. If it had been an intruder that night it wouldn't even be newsworthy now.

That I don't know. I'm not sure whether it's a subjective test (ie it's not unlawful to kill somebody you believe to be an intruder) or an objective test (ie it's not unlawful to kill somebody who is actually an intruder, regardless of your belief).

Edit: So I guess if it's the latter, it already is unlawful killing.

I still don't understand how he could hear a noise in the bathroom and just automatically assume it's a burglar when he knew full well he was not home alone, a normal persons first thought would be "it'll be just my partner" so you just automatically check where they are.

What makes it all even more unbelievable is that he went to the bed anyway to grab his gun, again not even bothering to take one second to see if she was there, he claims to have loved her but it seems that he had did not give her much thought on the night. He is certainly guilty of negligence in my book. He's either paranoid or stupid, or both.

Has anyone got any idea what his motivation for killing her was? (Assuming it was murder)

Yeah she was going to leave him for this bloke :p

Why "unlawful"?

I appreciate the point that, arguably, all killing is unlawful, but if it was a pure accident that's debateable.

Not all killing is unlawful, that's why it's called "unlawful killing", self defence is not unlawful, a "pure accident" is not unlawful.

It's reckless homicide, he didn't accidentally shoot through the bathroom door while having no idea who was on the other side.

She also keeps reverting to the harrowing emotions she experienced on the night, which is frustrating. Just answer the questions.
I thought that
"...blood curdling screams"

give it a rest

Regardless of whether he's guilty or not he needs locking up for being reckless with a gun.
