phoned in sick...went to a festival...got caught...can I get sacked ?

A guy where I work phoned in sick once and I found him down the beach after work. He didn't get a damn thing for it.
While he was probably in the wrong the problem is whether or not the sacking/disciplinary could really stick. Was there any way to prove he wasn't sick enough to be off? Being too sick to work and too sick to go to the beach are obviously two different things (depending on the job) and it would be difficult to prove in a hearing which he was on that scale.
 
I'd just go with,

It was almost the end of the day & was feeling much better thank you;) <<yes give them a wink
 
I actually got an "investigatory meeting" when I returned to work after being sick as I was spotted at my local shop.

When they asked me why I wasn't in bed I replied "Hungry, no food at home, or would you rather I died of starvation?"

And that was that. But I agree, sick people aren't necessarily going to be bed ridden.
I wouldn't expect that to be a problem. I've had to go into town to pick up medication while off sick as there was no-one else to do it. Nothing came of that but it's a similar situation. However, going off on a sickie so he can go to a festival is a completely different situation - he blatantly wasn't sick at all.
 
i guy who i used to work with injured his arm or leg , i forget which, he came in with a doctors note for a week off - fair enough

he came back to work a week later with a lovely tan lol

he admitted he went abroad to "re-cuperate" :D
 
so he wasnt one of the people that got stabbed at T in the park?!?! (yeah lame joke but we were reading the papers in dublin bus station after oxegen)

Just turn up in a RATM teeshirt (the battle for la but they changed it for where you saw them, so battle for glasgow probably) and a massive grin! (aka take it like a man as it was so worth going to even if you have no job now)
 
Dude, it would have been worth it just to see RATM live. Your Boss needs to understand the importance of this!
 
If i was caught doing something like that whilst on the sick, i'd be dismissed.

Your employers are called an "Employer" for a reason.
 
Why did your boss call you? You phoned in sick, unless he/she was calling to see how you were then fair enough. If he/she was phoning to see if it was genuine or not, then personally this breeches your rights. I frickin hate it when I am ill which is very rare 1 day a year if that for someone to call me ask you something. What if I am dead, who would you call then!?! Err hello i'm ill go away. You called in advised you were ill, you do not get paid for not being in so WTF. Don't worry about it mate. They sack you, then personally they sound like a bunch of sacks themselves. Tell them you propose to sue them for unfair dismissal. They called you outside usual working hours, how are they to prove you were at 'T in the park' during work hours and that you had not just got better in the afternoon and did not want your expensive ticket to goto waste. Then tell them to put that in there pipe and smoke it and walk out.

Well yeah, I was just mentioning something similar that's all. :)

I do think the OP is an utter plank, but then again i've done what he's done in the past to sit home and play computer games, so I can't really preach.

It's going to come down to who his boss is, and how lucky the OP is.

If you are any good at your job and they want to keep you they will use the disciplinary procedure to try to force you into line with the the first verbal unofficial bollicking, first verbal warning, first, second, third etc written warnings, final written warning and dismissal.

If you are a pain in the arse at work they will fast track the process to get rid of you.
