Rear Ended

My dad has been rear ended before by an uninsured driver before.

Took the entire claims process about 2 years to complete but in the end he got something for his car but it wasent much.
 
The reason I may pay an excess is that I would be claiming from nobodies insurance.

I have arranged my own solicitor as Asda legal team didn't contact me when they said they would and when they finally did they rang the home number (gave them mobile to call) so left a message and are sending me out paperwork aswell as the solicitor.

The solicitor I think will be a better option as I have spoken to him a fair bit and he understands my concerns.

The main thing is I get a car, my Dad said it isnt a problem to lend me a bit of money to go and get something.

I am going to get another GhiaX Mk2 as I know them inside out now.
I am going to aim for a MY2000 V/X reg with average miles, FSH and of course a minter.
 
Jesus that is annoying. Can you sue in this kind of a case? Hopefully it will be made much easier by the fact you have a witness to back you up. You might be able to get him done for driving without insurance?

Best of luck with it all, just make sure you keep doing everything in your powers to eventually screw the uninsured **** over
 
Sorry to be a downer again, but as another victim of an uninsured driver I can confirm it took about 2.5 years to settle. You have to pay a second excess on the claim from the MIB, and to cap it all the woman who hit me only got a suspended sentence for driving without insurance because she laid a sob story on the Magistrates :(

Can the legal expense cover I have be applied to my own solicitor?
Or would I have to use the solicitors my insurer uses?
 
Hard to say, but if the Solicitor is working for you "no win no fee" - you don't actually need your legal protection cover.

If he loses - no fee, if he wins - he gets his fee from the other party.
 
I did post earlier that I found out today that the chap that hit me IS insured on some sort of trade policy.

His insurer had no report of the accident. So they cannot accept liability until they speak to or somehow contact him.

How long am I looking at to get some money / fixed car then?
 
Unfourtunatly, a while I should imagine... as you were only insured TPFT your insurer doesn't have to take care of you.... it's entirely the other insurers problem if they are deemed to be responsible. Only once this has been determined can you get a hire car, as they aren't cheap and someone will have to pay. Your insurer simply won't take the chance - you only pay them to cover your ass should you hit anyone :(

have you got a company name

if you've got that, then your insurance company can go chasing them up. At the end of the day, its a rear end impact so its an open and shut case. Your insurer can submit the claim to them, and they can either accept the charges, or try and contest them. ANd if they contest them, with a rear end impact they will fail

brake lights working or not, he should still have noticed you had stopped and not slammed into the back of you. Its called paying attention, as even when van drivers with no brake lights whatsoever (all 3 out) have braked, i havent gone into the back of them.
 
That's basically what has happened but the solicitor is doing the work as apposed to my insurer.

The current problem is the bloke who crashed into me hsnt reported any accident to his insurer so they will not accept liability just based on my story.

That's understandable of the insurer but why the bloke hasnt reported anything is beyond me. He is acting like a ****, infact he is a ****. What does he expect to achieve by acting like this?
 
If you've reported the accident to the police, shouldn't that be enough for the insurers?

Or, if it isn't enough it should at least strengthen your case, warranting an investigation by his insurers?
 
There is a message on the phone confirming it is a write off and that I should phone to discuss value :)
 
Above all, I'm glad your ok, Cars can be replaced & all that.

However, like the Van driver said, WTF you doing stopping on a main road to give way to somebody?

If it was a "Give Way" sign, fair enough, I'll crawl back under my stone. :o

If it was'nt, why not just keep going and let the other driver find his gap when the traffic allows?

Not the same scenario, I grant you, but, 3 or 4 times every day I find myself having to pull up, usually very suddenly, because of some muppet (no offence implied) who's taken it into themselves to stop and allow somebody out of a side road!

I don't find issue with this when the roads very busy, rush hour for example, usually nobodys going at any speed to possibly be inconvenienced or held up.

My main gripe is when said action occurs on a near clear road! all the "giving way" driver has to do is to check his mirrors, see the roads clear and , obviously, realise the other car can quite easily go once you've passed, causing no problems to anybody.

Alas, this rarely happens.

Comes down to observation, from all parties on the road, sadly there seems to be little of it, nor thought about the possible concequences of actions.

Again, glad your ok, sorry about the car, next time, I wonder if you'll do the same?

PS, 95% of white van men need shooting. ;) :D
 
I HAD to stop as the car had pulled out from the side of the road blocking my lane.

If I hadn't of stopped I would have hit the N/S wing of the car.

I didn't brake suddenly either and it was 2-3seconds after stopping that the van hit me.

Even if I did brake suddenly I am entitled to do so for whatever reason I wish, he is not entitled to crash into me.
 
Sounds like he was texting somebody or just plain not concentrating then....

Hope you get things sorted out about the other guy's insurance. I can't understand him not reporting it though, especially if it is a works' vehicle.
 
same thing happened to my brother on boxing day - white van man was asleep and drove into the rear of his car as they were sitting in a traffic jam!

Seems to be resolved now, although he doesnt have his cheque yet. I wish you luck with your claim.

If the insurance company offer isnt good then refuse it and hopefully they'll come up with something better.

He has failed to report an accident, not clever, get the ******.
 
Hi,

I accepted £1100 for my Mondeo.
And am buying it from the insurance company for £60.

I did ok beating the bloke up from £900 I thought. We both had Autotrader website open and agreed on a value off of there.

The car is a Cat B Write Off! :eek:

Doesn't mean I cannot brake it for spares though ;)
