Rear Ended

Apparently all of my brake lights are at fault and he has contacted the police regarding this.

Ahahahah, this van guy is a right tool, even if this was the case he can't prove it, simple fact is he hit you end of story, he was not paying enough attention to the road, sounds like he does have insurance otherwise he would not have gone to the police with this, also the idiot probably forgot when he went to the cops after piling into you and using your lights as a excuse is that he should be done for not driving with due care and attention.

On a side note get his mobile phone records checked out, see if he was on the phone at the same time!

Sounds like things are on the way to being sorted even if the other guy is being a tool.

Must say big thumbs up to Merlin, sounds like he's being a star with helping get this sorted.

Not too sure what he is up to tbh. lol. He is just reassuring me things should be ok and he is pulling some strings for something helpful somewhere.

Always good to have someone with knowledge on your side if only to put your mind at rest.

Mk 3 TDCi Ghia is a lovely car, Dad had one as a courtesy car and I was very impressed, shame he went for an LX when he bought his own :(

Having said that the BMW is a LOT of car for the money.... choices choices hey!

Check your email.

Good luck.

I cannot beleive the guy wouldnt give his insurance details, surely his is obliged to do that regardless of whether he thinks he is at fault or otherwise.

I imagine he is trying to think of a way out of it, but at the end of the day he rear ended you so he must almost certainly be at fault. He has no way of proving your break lights weren't working, and as you said it is highly unlikely as they were not showing as blown on your AWs, plus the ones he did not hit are still working now.

The police can actually tell if a light bulb was on or off when it was smashed by looking at the filament in the bulb so if it was on they could easily tell by using a magnifying glass. So if they work don't worry too much. Not giving insurance details out to people will almost certainly agrivate the police and I doubt very much if he has reported you at all and sounds like he is stalling.

Please do keep us informed of what is going off though. Glad you're OK which is the main thing.

Merlin recommended a good solicitor who has been really helpful.

The chap is insured but hasnt reported the accident to his insurers, so it will take a little longer to do things as his insurer will not accept responsibility yet.

I am waiting on a call from a rental company now as I need the car to work it is being provided. :)

If you were stationary when he hit you, your brake lights wouldn't need to be on anyway, he should have realised you weren't moving and stopped..

Hey Tesla that BMW looks awesome for the money. I'm sorry to hear about the accident this tool of a van driver- it's always the white van drivers isn't it? Had loads of problems at work when the ***** courier crashed into the engineers Renault 21!!!

I am expecting a call from a hire company today, I hope they can get a car to me today, REALLY need it now!

This morning I was having a look at the damage from inside the car, looks nasty and all mangled up. I did find wedged inbetween the mess of metal and plastic the actual frame which all the bulbs plug into, all of the bulbs are still intact and unbroken

God knows how, I havn't tested them all but the indicator bulb works. lol.

Update:

Turns out the guy isn't insured with the company on the database as he cancelled his policy with them at the beginning of December. I think it will get worse now, much worse.

Dad has offered me a loan to get myself a new car, probably going to get another Mk2 GhiaX as I love them. Then pay him back once this is sorted but I reckon it will be a long process now :(

Cannot get hire car as they have no insurer to charge, so I am back onto my Mum's Micra insurance so I can continue with my job.

Arghhhhhh! That's awful Tesla.

Are you going to pay the guy a visit?

You do know, unless you do something about it yourself, you stand very little chance of getting any money from this fool. :(

No, the solicitor was very assuring saying there are many legal avenues etc... and I will end up with something.

There is also basically a pot for people to claim from when hit by uninsured drivers but a £300 excess is involved on this.

I will next here from the solicitor on the 3rd of Jan, he said that gives the database a chance to update if need be, all the companies including himself are off over xmas and new year and also he can get a letter out to the chap about the matter.

Can the police do anything?
I phoned them and they asked me to report the accidnet, I told him I already did hen I phoned the police at the scene of the accident. I have to report the accident in a police station instead. Talk about wasting police time.

I don't like putting a downer on the police but the bloke was really rude on the phone so I didn't care to talk to him much. I am going to sit tight and make-do untill I next hear from the solicitor. I imagine it will come round soon enough with this busy time of year anyway.

I am worried that I will need to pay an excess, I always though I wouldn't need to if it wasn't my fault, also do i lose NCB?

I am assuming the insurers will see it as his fault, I have that kind witness too.

sorry if this has been said already

you have to pay an excess if you claim on your own insurance. If you claim off the other persons insurance you dont have to pay your excess

*edit*

just read hes not insured

bugga

:(

hmm, sounds crappy.

Maybe a little visit to the guy is in order? Nothing confrontational, just say you were after a little reassurance that this matter will be getting sorted?

Anyhow, make sure you take him for every penny. Loss of earnings, damage to car, hire car, potential whiplash...
