Nightmare.

This is why I don't have a drop if I know I'm driving. Got a couple of mates who will drive out and have 1 or 2 and I always have a go at them.

This is a perfect example. Unlucky.
 
Of the numerous times I read stories of people getting caught over the legal limit to drive I don't think I've ever read one where there hasn't been a driving ban.
That includes people who drive for a living and have a mortgage to pay - they do come down quite hard on drink drivers and to be honest rightfully so.

As somebody else said, the legal limit for driving is actually 35mg per 100ml of breath.
So the fact you blew a 54 means you were more or less half as much again over the legal limit - you aren't gonna get to walk from this one.

Opting for a blood test can potentially save your bacon if you are borderline.
A recent story I read in the paper had somebody blowing I believe it was a 40, whatever it was to actually be prosecuted.
Anyway, he then opted for the blood test instead.
It took them 2 hours to get somebody to the station who could take the blood and by this time his alcohol had dropped and he was no longer over the limit.
With a 54 they could have waited quite a while to take blood and you'd still be over and there is no guarantee it wil take 2 hours to get somebody in to take your blood.
 
As someone else has pointed out the limit is 35 for breath and 80 for blood. Something doesn't add up. Get a solicitor, you might be able to get on technicalities.

Also does anyone now if any of these breath testers you can buy have at least a reasonable ability at measuring it. As there are some very expensive ones about.
 
2-3 times a year me and my wife visit some friends about 150 miles away, down on sat and return sunday afternoon, whether we stay in, have a bbq or go out I have zero alcohol, theres sometimes others go too if its a bbq and I get comments like "Have one", "God I'd have stayed at home if I didnt drink" or "You'll be alright after a good sleep" but it aint worth it
 
You were drinking and driving. No sympathy from me, even if it is a tiny bit over the limit. Drinking and driving never killed anybody, but why take the chance? Oh wait...

I believe that if its under 50, you have the option of blood/urine sample - this is where you may be getting confused.

Sounds like you were arrested at the roadside for driving whilst unfit..
 
While it is easy to see that you regret your actions, I have no time for anyone who would drive a car knowing that there was even the slightest possibility that alcohol may still be in their system.

You weren't as bad as a woman I recently rendered first aid to (she collided with a bus and then hit a wall, narrowly missing two bikers). She was completely wrecked and even admitted to me that she'd drank a bottle of wine although she asked me to keep this from the Police. Not likely. She later admitted to a plain clothes WPC that she had also drunk 3/4 of a bottle of vodka. Denied being drunk and forced me to have to travel 100 miles to give evidence at Court only to cop a plea minutes before the trial was to start.

I also attended an RTA recently involving a collision between a Range Rover and an older Honda Civic. Location was minutes from my house and on a straight road so it was a case of 'there but for the grace of God'. Civic driver was trapped and had severe leg injuries while the Range Rover was upside down but the driver only had slight cuts and bruises. It probably helped that he was blind drunk and pretty oblivious to what was going on around him. The upshot is that the drunk walked away (to prison) and the Civic driver is now confined to a wheelchair. The drunk is due to get out in six months but he won't be forgetting his selfishness any time soon as the injured driver lives three doors down from him.
 
It did a 35 when it did a blank test to calibrate itself, i was told by 4 cops that it was 50 :S

The legal limit IS 35mg per 100ml of breath
Most Police forces dont prosecute you until 40 and between 40-50 you can opt to have blood taken.
At 54mg im afraid your quite abit over the legal limit.
You will be looking at a 12 month ban unless your force area does a drink drive course where you will be able to get 3 months knocked off this if you attend the course.

The reading the machine gave of 35mg when it was first turned on is a test to make sure the machine is working correctly and within its limits. 35 is bang on and is fully functional and working correctly.

I'm curious as to why you only ever return to this board to post the latest **** up in your life? You then proceed to get fairly well slated and disappear for a while until you next feel like you need some attention.

I can't wait for the "I've just killed someone, but I feel really bad about it and have learnt my lesson" thread.
 
A field service engineer who used to work with was pulled for drink driving after a company do, he told his boss, was sacked immediately and was banned for 12 months with a sizeable fine (don't recall how much), and rightly so, anyone who doesn't have enough intelligence to realise that if you drink, no matter how little, you don't drive doesn't deserve to be behind the wheel anyway.

Say you were a tiny bit over the limit on the initial road side breath test. They then take you in to use the proper breath test machine. During the time between the two your obviously getting rid of alcohol out your system.

Is there anything you could do to increase the rate of (i dont know the word, "burning off alcohol") for example, running, faster breathing, increasing your heart rate generally?

I think if you still have alcohol in your stomach and you excerise you decrease your absorption rate, which would obviously be benifical given the situation. Is that correct?

*note* i certainly wont be drink driving before anyone flames me!

Nope, only the body's mystical powers can get rid of alcohol. The only way to beat a breathalyser is not to drink alcohol and then drive a vehicle, its not rocket science, even if you have had 1 its not worth risking your licence, job, house or even maybe killing someone.
 
This is why you always insist they take you to the station for anothet test (i believe you can do this and that they have to comply), the extra time could have put you under the limit.

Although i heard that from a pretty unreliable source, id be interested if someone knew the score on this for certain, i think theres a different type of test that they carry out at the station?
