I don't think this guy is anywhere from crumbling. Unfortunately, there are 'so called' businessmen out there that don't give a flying dog poo as to whether any authorities get involved and this guy seems like one of them.

I just hope that the OP get's his money back whatever the outcome.

Even if you record the conversation, it is meaningless unless you inform the other party they are being recorded. If you phone and say you are recording them, the next sound will be a *click* followed by nu tone.

As I understand it, as long as one party know t's being recorded it's legal and can be used to create (and back up) detailed notes of the conversation.

The recording itself might not be usable in court, but if there is any query over a written record of the conversation it is I believe usable to back up that transcript (IE if there is a query about it being accurate in a particular place).

That is a joke though, he knows you have been waiting for the refund for ages if he was serious about sending the cheque he would have least posted it recorded/special mail.

I really hope you get the cheque but even if you do I would not be surprised if it bounces.

It costs like 50p to get it sent recorded. That is the least he could have gone. If you had left that 1500 in an ISA for 80 odd days you would be getting a few quid out of it.

Been reading through the thread. OP made a mistake, left it too long. Hope the cheque arrives, personally, after a week should have gone down with some lads and demanded the full money.

Should have also dropped off the jeans to him personally and got your full refund. If the cheque doesn't come, seriously, go down there and get the full refund.

I feel sorry for you and hope you get your money back but i think it was a bit of a silly purchase to be honest. They are sellable, doesn't say anything about them being in good condition. Anything is sellable.

The lesson learned here is, don't but clothes from ebay. Bulk buying from ebay in order to make a quick profit is also an espically bad idea, done all to often to try to avoid import tax.

postie doesnt come until about 11:00.

However, Phil phoned me last night at about 8:45.

On the earlier phone call i dont think he understood what i was saying and think he thought i was just asking have you sent it. Because, he phoned me and said hiya mate, didnt get a call off you... did it arrive?

I said no mate... postman came early and nothing else arrived. He said ahhh... well it was defo sent mate so you should 100% more than likely receive it tomorrow. Let me know once you have mate.

So i cant understand why he would phone me in his own time to say that if hes fobbing me off?

So according to him it should be here today.

I rang him and said Phil... nothing. Postie has been and still nothing. I said "look mate, ive been very patient and polite but if it isnt on my doorstep tomorrow i will be taking legal action. He said Luke, there isnt any need for that because its 100% been sent to you 1st class, and if its lost knowbody else can cash it as its your name only. He said, im off tomorrow but ill leave my mobile on so you can ring me and let me know if it arrives.
