They may already have the cash on "hold" so you cannot ask the bank to decline the payment as it's technically already been reserved by them using your permission to do so.

The bank would then ask you to try and resolve the issue with the retailer before they would step in.

He placed a order with a company that he knew and had stated had zero stock and gave no ETA of dispatch because they didn't know when the next batch of stock would get to them.

Now he wants to cancel said order.

IMO wait it out, it's obvious why you ordered from there in the first place to save £20, if you wanted one straight away you should have ordered from somewhere which had stock and paid the extra £20. You knew what the situation was before you placed the order so I wouldn't exactly stick all the blame on the retailer for the way they process orders.

They get stock quite quickly, the maximum you will be waiting is 2-3 weeks since they went out of stock.

I wouldnt be in a rush to save £20 knowing how poor Gamestops overall service is. Just get it from a reputable seller, not that hard to find one...

ps3ud0

kidloco, try War Thunder and Don't Starve. AC4 is good as well if you haven't played in previous gen.

Tried War Thunder, just couldnt get into it, ill maybe give it another bash.

Dont starve was interesting or a few hours but soon becomes repetitive.

AC4 - Finished it on PC. Really enjoyed it though, best AC since 2 I thought

What about the distance seller regulations

They've said I can refuse delivery when it arrives - and they haven't charged me yet. So I doubt there's any relevant consumer protection.

Honestly I don't think they've done anything awful. But I doubt I'll be ordering from them again without a similarly convincing promotion!

I sent a reply moaning that 'it's been processed' wasn't a very convincing explanation. I've now been told they're 'doing their best to try to' cancel the order... will let you know if I hear any more.

Yes and no - I knew it wasn't in stock, but I also assumed a basic level of competence. I've never previously come across a retailer that can't cancel a pre-order (which is how this was described). The website even tells you to email them to cancel an order!

Similarly I'd be OK if 'processing' meant 'we've printed the packing slip, it's going to be dispatched soon, it's too much hassle to find it in a box and take it out again'. Since they don't have any stock I doubt that's what's happened here (and if it was, why not say so?).

Consumer Protection (Distance Selling) regulations 2000:

"Your right to cancel starts the moment you place your order and doesn’t end until seven working days from the day after you receive your goods"

Just quote that to them.

He isn't being refused his right to cancel, they are just using a bed method to cancel it.

Did it have free delivery?? If not I suspect that's kinda what the scam is, if you refuse to accept receipt, they would probably only refund the console and not the delivery.

Anybody get the Ghosts DLC today? I had to large files to download, one 5.1GB and one 5.3GB, downloaded both but only one installed. It says 'waiting to install' on the other file in my notifications, along with a season pass which is also 'waiting to install'. Should I delete them?

Anyway, I just asked to cancel and they say this is totally impossible and I'll just have to refuse delivery when it eventually shows up (weeks? months?).

That says to me they are refusing to cancel the order. So he needs to tell them that legally they have to cancel it.

Liking the new headset.

Audio obviously isn't amazing compared to what you can buy, but the features are great, it's comfortable to wear and the mic is decent too.
