Hi my wife sold the house we got married in 2005 she sold the house in 2021. We separated 2018. My name was not on the deeds due to my credit rating at the time. Is this legal ?

In before Yes can send pics :)

If your name's not on the deeds, then that makes it her house, to do with as she pleases. That said, are you still married? What exactly does 'separated' mean?

Not entitled to anything then. You not on the deeds.

EDIT: You may be entitled since you still married..
Go get a solicitor/lawer.

Consult a solicitor. It's possible the house would be considered a marital asset in which case you may be entitled to half the profit from the sale.

A lot will hang on whether she bought the house before you married - in which case, if you've not contributed financially to it it would likely be considered a pre-marital asset and hers to do with as she pleases.

However, I am not a lawyer and could be wrong.

Still married

In that case, I'm not exactly sure what the next steps would be. In a divorce the assets would be split - you might get a share of the proceeds of the house sale even if your name wasn't on the deeds. BBut no idea what could/would/should happen if you're still married. You'd best get legal representation TBH.

Read the thread people - the OP is still married.

That was posted after the OP's initial post.

If still married - then you need to seek legal advice - If you made contributions to the upkeep/bills etc of the property whilst you were married/living there - then you have some potential rights to proceeds from the sale.

But it will cost you a lot in legal arguments to get anywhere.
