All goods must be:

  • as described
  • of satisfactory quality and
  • fit for purpose
If they're not, the retailer is in breach of contract and you have a claim under the Sale of Goods Act
Who is responsible

If your goods fail to meet any of the above criteria then you could have a claim under the Sale of Goods Act.
If you want to make a claim under the Sale of Goods Act you have several possible ways of resolving your issue, depending on the circumstances and on what you want done.
Your rights are against the retailer – the company that sold you the product – not the manufacturer, and so you must make any claim against the retailer.

"As described".

4GB VRAM is the description on the box, on the retailers websites, in the reviews, and by the manufacturer.

A GTX970 does have 4GB of VRAM, so what's the problem ?

It's the way the VRAM is implemented. It's done in a way that wasn't mentioned by the manufacturer or the retailers. It may not make much difference, but the 3.5GB + 0.5GB does make a difference that wasn't mentioned.

For those that say "there's no problem, you are just being fussy", what if NVIDIA had gone with 3GB + 1GB, or 2GB + 2GB ? You've still been sold 4GB of VRAM that you`d expect to perform in a similar way to other cards with 4GB of VRAM, but doesn't.

NVIDIA need to be held to account, otherwise it gives the go ahead for all sorts of technical deception.

If graphics cards manufacturers are going to partition VRAM, customers should be told, especially if it has an impact on performance in certain situations.

That is why you are the best Gibbo!

It is very reassuring knowing that you step up straight away, so far I am happy to my OCUK 970 (iper fantastic) yet despite being "on the green team" Nvidia really made a VERY VERY VERY BIG MISTAKE which clearly was done on purpose as I am sure it didn't take that long to realise what they did.

In all of this long protracted ordeal this is still the single most absurd point being brought up.

And if you all take a little longer than 5 seconds to think about it you'll quickly figure out why .................

The difference between a 970 and a 290X power draw wise is the same as an old fashioned light bulb.

Do you game in the dark ?

:D

No but I game without sweating now. lol Light bulbs are fine where they are, on the ceiling.

I really do hope i can get a hotel with AC or windows i can open, or even walls that dont isolate a 100% if i ever go to england, doesnt seem to be that common based on what you guys will say when it comes to owning a 290 card :o

I`ve had a think for much more than 5 seconds, and I still can't figure out why the point I made is absurd.

Please enlighten me.

I'll give you one of many examples.

An AMD 295x2. Its listed as having 8GBs of Vram , Physically yes it does , can it use all of it ? yes it can, however you go north of 4gb vram usage and its all going to go boobies up.

Isn't that effectively a crossfire setup on a single card ?

My understanding is that in a dual card setup, the combined memory doesn't perform like it would if it were on a single card.
