Alcohol and ability to consent

If they are looking to change the law regarding rape (and the whole drunk consensual angle is so open to abuse its clearly ridiculous) they also desperately need to prosecute those who falsely claim rape. Its potential, given the accused may have their details publicly released, to ruin someone's life is clearly evident.

I would prefer to think the police spend their time on actual rape cases then having it wasted on those who cry wolf.
 
Count drinks from cctv(or use card charges) or study how the victim was moving from cctv.

Short of using an evidential breathalyser before the act (and during) there's no solid way.

By the same token, a bar in theory shouldn't be serving anyone who is drunk. Not intoxicated, but drunk.
So, how did someone get into a position they couldn't consent in a public licenced facility?

It'll eventually come down to mobile breathalysers, and people videoing themselves consenting prior to videoing the act...

How does CCTV prove the drink in your hand is alcoholic or not?
 
A friend said this to me last week, I was literally gobsmacked I didn't know how to reply. And again it's come up, and I still don't know.

What I do know is I don't like the notion that only men can rape.

Bear in mind that's not necessarily his opinion, that's actually because in law rape requires penetration, thus only men can rape, women can merely sexually assault. I think, I might be wrong :p

Well, considering that one of the parts that defines rape is:-

intentionally penetrates the vagina, anus or mouth of another person (B) with his penis

and as only men have a penis then I'm sure you can understand why only men can commit rape.

Anything else is sexual assault, not rape.
 
We are all going to have to start carrying a breath tester with us and we will have to make chicks blow on that before they blow other things.
 
I feel sorry for those on the dating scene. You'll need a road side breath test kit and a legally binding contract of consent by the years end.

Yup. I know 3 people who've had to face similar accusations. One of them even went to trial. Name in the papers, everything.

Was of course found not guilty. Was the woman charged with anything for dragging his name though the mud and wasting countless taxpayer money and police time? Of course not.
