If you win (which I am sure you will), he will have to pay your costs!
He may have to pay a small amount a week if he can't afford to pay upfront, but he WILL have to pay you back everything.

And no this is not the end of the thread because this is not the end of the matter. I am going to continue this and take him to court, and as Oliver has said some people have expressed they wish to know the outcome of this. If you are not bothered anymore, don't read it! Plus it is good to have everything documented. This matter is far from over!

Why don't you just address a letter to his parents (Mr & Mrs ???) outlining the problem, giving your evidence and explaining the future steps you're prepared to take if their son doesn't compensate you?

If they're 'normal' parents you could find the problem resolved quite quickly and amicably.

The only downside to this is that you would have to give details of some of the evidence that you have against the lad. But, if the evidence is that damning then it may compel them to deal with it now so they don't have the hasstle of dealing with their son's issues later. Even if they turned out to be complete 'chavvy n$pple heads' they 'may' still see the advantage of stopping their son digging a deeper and deeper hole for himself.
 
There is no guarantee that he is a kid anyway, yes it does seem to look that way, but we don't know for sure.

I've been told the solicitors offer a short free session to discuss your case, and whether they think it is worth it or not. I will see how much they think it will cost, and what I would have to pay, if I pay anything at all, as some of you say, If I win, he should pay, and I am pretty confident I can win.

Does anyone reckon I could take legal action against eBay? Clearly there is something wrong with the company if they keep ignoring me, and all the evidence I have given them.

You can, anyone can - but you would hit a huge legal brick wall as they will have experience and 'people' who deal with this type of complaint all the time. My advice would be to just go after the seller as he will be legally unprepared.

eBay will have every step legally covered as they've dealt with this type of complaint thousands of times - it's a hazard of their business and they will be more than prepared for it. I expect you would have to follow endless processes after process that will eventually leave you legally in 'nomans land' and make you feel that you've just had your balls sauted and handed to you on a platter.
 
I'd say it's definintely worth seeing the Solicitor for free first, but after that, I’d write him a letter saying that you will be taking legal action, and offering him the chance to settle out of court.

You could always ask during you free session, if writing such a letter would jeopardise any future court action (you don’t want to be accused of blackmail for example)
 
Well done, Serraph, for taking this to court, I hope and suspect that you will win the case. You would if I was the judge (see my previous post !).

hey mate, seeing as you say you have exams coming up I take it you are a student. Can you not apply for legal aid and hit him with the full power of the solicitor without it costing you a penny?
 
Just a thought. If your paypal account is empty, and you have a credit card registered on it, when ebay/paypal come to take the money out could you not get the CC company to fight the case for you?

Hmm, I can has legal aid? Might be something to discuss with the solicitor ...

I have appealed the decision made by eBay, giving them all evidence again, and telling them I will take the matter to court if they still side with him. I doubt it will do anything, but it shows I have tried absolutely everything with eBay, and shows how useless they are. You never know though, might actually get through to someone who will read it!
 
is jaybee a big bloke? must have balls to to just visit someone to discuss something thats pretty much definitely cause a confrontation.
