Yep, was wondering about this earlier. Car needs a wash anyway so may try and do it this weekend.

PCP term is coming to an end but replacement delivery date is unconfirmed and likely a while away. Another thought I had was to just hand the car back with the damage and see what they say, I'm getting screwed either way so may offset by saving a few months of payments and other costs. Only concern with that would be interrupting my insurance and having to restart NCB.

I'd be tempted to wet sand and machine polish it, then go from there. That may well reduce the visible damage to a level where they won't screw you so much with the charges.

It's at Sytner BMW now and they quoted £25,500 to repair it! it's now a total write off, I think the rear axel must've been heavily damaged, it got shunted about 6 foot up the kerb and damaged 3 wheels plus the front splitter aswell.

That's shocking. Likely damaged the Diff in some way potentially. 2x drive shafts, wheel bearings, brakes, I could see it all adding up.

Any thoughts of a replacement?

Sorry to hear that. At least you know the culprit and weren't hurt (little solace I imagine).
 
There's no evidence to secure a prosecution, unless there's video evidence of the incident occurring.

The driver hit a stationary vehicle, seemingly with no other party involved. Is that a sign of competent observation and driving skill?

I'm not a lawyer and I haven't seen any evidence, so I'm not entirely sure how you expect me to answer that question.

I see zero reason why the police would pursue any charges based on what I've seen.

Please do enlighten me why the Police would pursue charges based on what you have seen.

Are you a prosecutor? Are you in the Police? Do you have any real world experience why based on the few pictures that the police and public prosecutors would be remotely interested?

I've just explained. It literally fits the definition of the offence.
 
driver must have given an explanation -
looks like what happens on our high street single parked vehicles on one side, and if you were at end of parked line as a lorry came one way and white van man on the parked side, someone has to give way.

Do you know how the court system works in this country? The Police will not press charges unless they are completely and utterly convinced that they will get a successful result in court. There is literally zero evidence from the few pictures to make any charges stick. It's a job for insurance as frustrating as that may be.
