Car clamped, help and advice needed quickly

Iirc 14 working days or so. it is not the days in question here but the fact that it is joint btw me and my girl friend - she due next month, She aint happy about the whole thing and one or two things ..... I dont wanna go into details as she frequent here sometimes, whilst "browsing" **snooping on me**

I feel like the whole world is upside down and not going my way at all today.

Yes it is. You tried to dodge the system and lost out and now expect the rest of us to bail you out. No chance.

Pay your debt and don't waste any more police time and taxpayers money. If you can't afford it in a lump sum, then take the consequences on the chin. You messed up. Deal with it.

I can sympathise with your situation but you handled it all wrong.

What do you mean by your mechanic? Is this a garage or just someone you know who is a mechanic? Did they not tell you about the fine there and then when you picked the car up?

Why didn't you make a fuss at the time to the mechanic and even if they hid it from you until you got a reminder in the post, why didn't you go down there and ask why they didn't tell you.

We have a clamper operating on our car park and two lads went off and bought bolt cutters, cut the chain and off they went. Clamper always takes a pic and records the vehicle details. The police had to go to the lads house who were potentially liable to criminal damage.

Only in this country!

He is my friend (the mechanic) He is aware of the whole situation but believe it or not he travelled home for his mum funeral.

I fowarded all the right document but the court failed to act on it and when the ballif made the initial contact via post i emailed then and forwarded the same documents i gave to the court. They did acknowledged it BUT said they will get back to me so as to what to do. Now that was what i waited on but i got the ballif at my door this morning instead. Even though they claimed they got back to me i didnt see anything so the dispute goes on....I feel drained.. :(
 
I can honestly not believe you have asked for money on the forum. :rolleyes:

As scuzi said, you have dug yourself into a large hole here, don't expect others to bail you out of it. Can you not go to actual freinds or family?

I didnt dodge the system, perhaps you didnt see my other post. if a car is in my name, why would i wanna refuse payment if I WAS THE DRIVER AT THE ACTUAL TIME?

I wasnt the driver and i did try to get it sorted but it appears there is a breakdown in communication of some sort along the line.....whichever way, i will have to pay.

Can you not still do the old let the tyre down and whip the clamp off, or have they changed the clamps so you cant do that now, and there was another way as well i think, reversing or summit, i dunno maybe im talking carp again. :D
 
You have left it long enough for a fine to excalate from what, £60 up to £800~, that takes a LONG time (i should know, ive had a parking fine rise from £30 to £200, and that took months)! You could (and SHOULD) have sorted the problem out straight away. You only have yourself to blame (not even the driver at the time, as you must have had months to chase him about it, even with legal representation if needed).

You didn't dodge the system, but you blatently tried to. I'm actually pretty sure that from reading your response to the situation that you had every intention of playing the race card if the Police were to try to remove you from the car.

The car is in your name, that means that you pay the fine regardless of who was driving the car at the time. Perhaps you'll be more selective in future as to who you allow usage of your car.

There's no breakdown in communication. You won't pay the fine, do it and don't ask for help here. You wasted officers time from attending to other possibly more pressing matters to watch you try to rewrite the law.
 
I'd have just paid the fine straight up. Then if somebody owed me money sort it out.

As far as the law are concerned you would be responsible for who drives your car anyway, and you'd have to take legal proceedings against them if they didn't pay up.

Another lesson learnt I say.
 
If you are clamped, can you legally sell the vehicle to someone else? I would have thought that the debt is with the owner - not the car, thus selling the car would effectively force the clamper to remove the clamp? They would have to persue your debt via other means.

Or is the bailif/creditor entitled to ownership of the vehicle untill the debt "secured" on it is paid?

I dunno, just an idea.

Yeah or if he's a 'mate' then let him either pay you back the money or do a couple of services on your car gratis.

Oh well, sounds like a right old pickle but hopefully you'll get the money sorted.

Sorry - but any sympathy I might have had is evaporating rapidly.
The facts as you have posted them are that a parking fine was incurred while your mechanic drove it - true?
You are tryingto avoid paying that by saying that you weren't the driver.
Why are you not understanding the law as written on the link posted by Burnsy2003 - your argument is not a valid defence and you the registered keeper of the car are 100% liable for the original fine.
This is why the court did not cancel the original fine.
This is why a summons was issued agaisnt you for non-payment.
Stop deluding yourself about submitting forms/breakdown in communication.
You are the registered keeper of the vehicle and in law you are liable for the fine.
End of argument.
 
Hahahahaha, this thread has got my laughing my ass off - why the hell did you not go to court? And as the 'I wasn't driving' didn't wash with the court, why did you think the Bailiff wold give a damn? And why the clowning around with the Police?
