Well stannis offered to legitimise him, and offered him winterfell if he liked, he turned down stannis and remained commander of the night's watch. A will may or not have any bearing at all. Howland Reed should show up with Davis and Rikkon at some point for an air to Winterfell in a forthcoming book, so John being name heir to the North might not matter so much.
He is heir to the entire throne in all likelyhood, assuming he gets legimised one would think, or marrys Dany. They wed brothers and sisters didn't they?
Who knows where the author will advance it.
