The legal action of Philip Green against the Telegraph has been formally ended by a High Court judge. However, the five employees who made allegations about him remain gagged on the basis of NDAs (Non Disclosure Agreements).

The Telegraph plans to publish the details of the allegations against Philip Green in Saturday's newspaper. It has also allegedly published an audio recording of Philip Green in which he threatened to "bankrupt" the Telegraph if it printed the allegations. He has supposedly been left with a reported £3m legal bill and has been ordered to pay the "bulk" of the Telegraph's legal costs.

His wife's Monaco Express card? That'll do nicely.


It is long past time that the Government did something about the abuse of NDAs to cover up questionable behaviour - get that dirty washing out into the open air.

If someone is forced to sign an NDA, I'd agree. If someone agrees to sign an NDA, I wouldn't. If a person agrees to be paid for something and is paid for it, they should do it.
 
Yes, of course. It was briefly made public in a number of trials recently. You already know that, so there's no point in me telling you again.

You also already know that pressure is applied to increase the conviction rate for men (not guilty men - just men) - that too is public. Very public. It's not at all hidden.

You know these things already. As does everyone else. It's just that some people think it's a good thing.

The opposite is true. The Police may get pressure to increase referrals to CPS for charge, as with all crime, but CPS are pressured to not pursue any case that is uncertain to get found guilty. Rape case are long, expensive and often have very little tangible evidence other than one word against another. It's a barristers nightmare. Convictions usually only come with DNA, video or multiple victim evidence.

The case in the MET that collapsed appears to be primarily due to incompetence on part of the police and CPS. If indeed he told them about the existence of texts in interview then his defence would have been aware (as they sit in on the interview and have full access to the records) that they had an ace up their sleeve that could have been used at DCS or pre-trial review stage to have it dismissed. This then also allows the prosecution to answer the challenge and attempt to overcome it. The fact it wasnt raised earlier suggests the defence waited until that last possible minute to have maximum impact.

Rape cases are very complex and sit just below the work needed for attempts murder cases. Wheres as the latter involves an entire team of investigators, sexual offences are usually only investigated by one. Add to that the detective may be inexperienced, have a dangerously high workload, have no expertise in digital data examination or have poor supervision. It's not difficult to see how serious mistakes can be made.

To some degree I agree with this but when it starts to become ndas to keep quiet about criminal stuff I think it's different, now he knows he can rape any woman, you can imagine him raping some poor 18 Yr old girl, her screaming and crying and at the end he says "go to the police no one will believe you, I've done it before and got away with it.. Now take this cash sign this and shut up I'm off for some more good ol raping fun, anyone got a pension fund I can rape as well?"

How exactly do you KNOW that nobody has accused Philip Green of rape?

Because it's not all over the news and it would be if they had.
