Oscar Pistorius thread

What drugs test did he fail in competition? They didn't strip Christie of Medals after he failed a test later in life so why strip a man who failed no test? Unless he admits using them the last 5 years or whatever they can't really do ****.

They could do - look at Lance Armstrong, who never (officially) failed a test. Nothing will get done though, it will all get swept under the carpet along with loads of other high profile positives.

He's back in court this morning.

Oscar Pistorius is back in court in Pretoria for a bail hearing that may reveal further details of the murder case against him.

Prosecutors plan to pursue a charge of premeditated murder against the South African Olympic and Paralympic star, a charge he is expected to deny.

His girlfriend, model Reeva Steenkamp, was shot dead at his home on Thursday. Police later recovered a hand gun.

She is due to be cremated at a private ceremony in Port Elizabeth later.

Mr Pistorius arrived at the court house before his 09:00 (07:00 GMT) hearing, which will be the first since he broke down and wept at an initial hearing on Friday.

Prosecutors are expected to outline their evidence against Mr Pistorius to support their argument that he should be denied bail before his trial begins.

Mr Pistorius is also likely to enter a plea for the first time and apply for bail.

Armstrong wasn't asked to give back his Olympic medal until after his Oprah interview. After he admitted cheating and doping.

So all the prosecution have said (according to the BBC) is that he got up, put on his leg, walked 7 metres then shot through the bathroom door. Shortly afterwards he broke down the door and carried the body downstairs. Not sure how that indicates premeditation really. If he did think it was an intruder, then I guess he would have to put on his legs to investigate. He may just have been trigger happy. If the prosecution have nothing more, then it will be interesting to see how they paint this hero of South Africa as a killer (edit - read as cold blooded evil evil murderer!).

No mention of a bloody bat and smashed head either.

My speculation is that if this was anything other than a mistaken shooting, given the bathroom thing, was they had an argument, he went for the gun, got a shot off, she ran to the bathroom and blocked the door by shoving against it, and he shot through the door where he thought her body would be.

I speculate that the bloody bat thing is either made up, or was from a previous incident with old blood on it, as I can't speculate on a scenario where he would shoot her and stove her head in given this bathroom door thing, unless that bit was staged after the stoving as some kind of "didn't see it was her" defence.

You understand, don't you, that "premeditation" need only take a fraction of a second?

Hmmm, no, in my mind that wasn't how I was defining premeditated murder, I was looking at it as something that wasn't a snap decision or made in the heat of the moment. Although even the magistrate is querying the definition...

It sounds like the prosecution are are chasing a trumped up charge, why not go for a lower charge that is more likely to succeed? Who premeditates a murder by shooting someone through a bathroom door?

Doesnt pre-meditated murder just mean he intended to kill her ( as in it wasnt an accident, or a case of mistaken identity)

As in, he thought in his head, "that is my girlfriend and i am now going to pull the triger on this gun and shoot her dead"

Pre-meditated means it was planned beforehand, like something out of a Columbo episode... rather than just being a spur of the moment roid rage thing.

It's possible it could have pre-meditated but the execution of the plan it went a bit wrong and she got away and took shelter in the bathroom.

Nope, murder means intent, pre-meditated essentially means it was planned or at least the intent was there beforehand.

I don't believe it for a second.

Nonsense, Bolt has the perfect physic to be an extremely fast runner and has consistently been very fast over his career!
Yohan Blake however is more suspect considering his size and his large increase in speed over a relatively short time span, that combined with his 2009 positive test for 4-Methyl-2-hexanamine (which wasn't actually on the banned list btw!)

That said until they test positive for a banned substance they should be innocent until proven guilty imho.

I'm just amazed they've pushed this to trial so quickly. Knowing how the SA justice system operates, I'm amazed they were able to get a solid case together in so little time.

His going to struggle to explain away the witness evidence from the neighbors about hearing arguing and then gunshots!! (Provided the report of this in the paper was accurate)

Not sure how similar the laws are in SA compared to here but in the U.K you would have a seriously hard job convincing a jury/judge that you were in fear of your life at the point of shooting through a closed (possibly locked) door!
The sensible and logical response would have been to grab your gun and exit the house as quickly as possible and then call the police!!
