They haven't had the proper ballistics back yet so kinda strange for Botha to say all this even if he does have some "experience with forensics". :confused:

It's over half a kilometre away though. While sound can travel during the dead of night, can they even clearly tell whether the lights were on from that far away? As likely their properties probably don't even look directly at each other.

The Defence also intervened that the witness heard eight shots. So that either shows how far away they were, or that the testimony isn't do credible.
 
It's funny how it can all change between the prosecution and the defence. You hear the evidence against him and it seems as clear as day, then you realise that it may not be 100% accurate and more questions appear.

- Witness was 600m away. Looking on the images of his house and the surrounding area, that is a huge distance to hear an argument from. It also doesn't look possible to be 600m away and see lights in the house. There are other properties surrounding the house, surely someone else would have heard the arguing.
- She was on the toilet, she had an empty bladder which would imply she had been to the toilet.
 
Why would she have phones with her if she got up in the middle of the night to go to the toilet?

While we dont know all the facts I think we can read a lot from the police's response to the incident. They seemed to know straight away it was cold-blooded, pre-mediatated murder and charged him with it almost immediately, presumambly without having a lot of the ballistics evidence which could incriminate him further. For anyone arguing his innocence I suggest you toddle off and post in the moon landing and 9/11 threads.
 
What the hell is going on with this case!?

This doesn't paint a good picture for the Justice system in SA. The prosecution seem to be trying to base an argument on evidence from a stupid distance, with live update saying the witness saying 8 shots were fired. They only found 4 shots :s Oscar seems to say stuff that goes against some of the evidence as well...

It's all just a bit of a mess right now it seems. The prosecution need a better lawyer, and the defence need a better story.

The Barry Bateman tweet is making this look more and more like Oscar's story is going to be the one that comes out trumps.

- Reeva has no signs of defensive wounds, nor assualt (where the hell did cricket bat come from)
- Reeva had an empty bladder - not to be expected at 3AM
- Oscar called Netcare at 3:20AM
- The Witness is laughable - 600m
- Someone (not said who) conceded they couldn't find anything inconsistent with Oscar's version of events.

It was used to gain entry.
The stuff about it being used as a weapon and covered in blood was speculation by media which I think a relative had initially tried to suggest.
 
The cricket bat was used to break the toilet door as it was locked.

Says it all really... but I guess that's what happens when you have the prosecutor being cross examined about everything during a bail hearing. They haven't even had a ballistics report yet!

Absolutely.

It does really seem like the bail hearing is the trial in this case. If he gets granted bail I suspect he'll be acquitted. Although evidence may change that.

Definitely a poor justice system in SA.

At the moment, the worst thing that may happen is he get's a slap on the wrists and a fine for possessing unlicensed ammunition.

Which is wrong. Regardless of who the victim was, he should be charged with murder as there was intent to do so when firing blindly through the door into the toilet. The prosecution should have been more thorough before bringing the charges against him it seems.

What a delightful human being you appear to be - not bitter about anything it seems.

He still killed her and I'm sure will face the appropriate justice for that, but the argument at the moment is whether he planned to do it, or if it was accidental - the decision today will influence the whole direction of the trial later in the year I would imagine

To be fair the first thing I do when I go to the toilet is find my phone and go to the toilet. Reading facebook,news and interwebs is important to me and the only time I look at some stuff. I only do this for number 2s but ladys always sit down so have my mobile toilet time :D

I must add that I dont know if he did it or not. But jesus 600m is a huge distance to hear a aurgement. Like look at the size of a 400m track and you get the idea and its not in a straight line.
 
I'm really not surprised that they've managed to screw this up already. Calling all this stuff into question before they've clearly had time to examine the evidence properly is utterly reckless, they look like complete amateurs now. It was a high-profile case, and instead of taking the time to do it properly they've done the typical SA thing of rushing it through the doors because they think taking longer will look incompetent.
