hm, I've seen a lot of pokemon fans refer to them as pokemon too along with calling the game pokemon with guns. There are also a lot of people saying its what pokemon arceus should have been. Granted my source is mainly reddit so meh. To me they look like pokemon.
I'm not invested in this at all. I don't care about suing / what nintendo should or shouldnt do etc, just stating how similar it looks, to deny there is no similarity is pretty odd imo.

No. Pokémon are Pokémon.
Granted I only vaguely remember the original 150 but unless they are recoloured assets then they aren't even close to the same.
In much the same way games with a turtle don't get shut down because Nintendo made Koopa Troops.
I mean it's clearly piggybacking off of Pokémon, whether any of it is legally problematic is a different question. I imagine the studio took a pretty close look at the laws and skated as close to them as possible.I also didn't mention anything about mechanics but you latched on to that for some odd reason. But as I mentioned after the pokeball capturing system looks similar (they could have used a net or something else), I then likened it to ghostbusters to show you that yes the mechanics aren't something new but from the design of the game it just reminds me of pokemon. They even have a "paldex"... look I'm not into wasting my day arguing over silly things so lets leave it at that.
