RTX 3090ti RMA'd, B Grade 4070ti offered as a replacement

I have had another response from support. They say the only 24Gb cards they currently have in stock, are not available for my replacement, and that the only thing they can offer me is a partial refund and suggested I then purchase a 4090 or 7900XTX as these have 24GB of VRAM.

No option to send it off for repair?
 
I'm at a loss as to what to do really. I seem to be losing out due to them not having stock of any 3090ti's. If I were to take the refund and then get another 24GB NVIDIA card I would be left 500 out of pocket.

Their first offer was an insult, the 4080 was better but not great however them offering £1100 for a 18 month old card you bought for just over £1400, when you can get 3090 ti on ebay for less well less than £1000 is a very fair offer.

You've had 18 months usage for £300 and what they are offering you now is VERY fair. A warranty doesnt entitle you to a full refund after 18 months of usage. If im being critical of all this it kinda now sounds like you're fishing for a free upgrade to a 4090 which is a bit greedy.

Accept the money, add some more to it and buy a 4090 /thread

I originally paid £1,429.99, and they have offered me a partial refund of £1,092.36. The card is a year and a half old.
The money offered is actually pretty decent tbh, if it's for work-at a cost of ~£16 per month over 18 months-I'd take the refund.

This is the main reason I don't buy from OcUK. I don't think anyone else does this.
It's consumer law to reduct for use when a replacement/repair can't be sourced, the onus is not on OcUK(who is literally a reseller) to remedy a fault.

Goodwill however is on Ocuk.

Personally I'd take cash refund and purchase a brand new 4080, but that'd be for gaming, how much of an impact is a faster core with less vram over the slower core with more vram i don't have a clue.

You entitled to think whatever you like, but after their first offer I am allowed to be sceptical of any other offers they provide me. I not looking for a free upgrade as you imply, I would have loved for them to just send me an identical 3090ti back to me, and avoided all of this.

Seems more than fair.

Whilst goods should be expected to last a reasonable amount of time, for a high end GPU you'd expect it last and be relevant for 5 years?
1429.99 / 5 = 285.998 * 3.5 = £1000.99


I would push them to give you full ticket price. Maybe involve ombudsman if needed. They will cave eventually
No they won't - they legally don't have to. Any refund given is entitled to have an amount deducted for the time that it's been used.

Equally, whilst it's pretty crap that an exact replacement isn't available, would you a) rather have the cost of all that extra inventory passed on to consumers, b) the cost to the environment in extra ewaste when all the unused stock is disposed of
