One thing you could do is argue you didn't enter a rental agreement you bought the card from them. Look at (an auction site)'s completed sales and find the true value of your card. Then forward the information to them and ask them to raise their offer of compensation so you can purchase a working card.

Not that you should have to do this of-course, just trying to think of options
 
Ive shown them my reply from xfx, one of the fellas on the returns dept forum has said hell ask the manager about the situation tomorrow. xfx have also urged me to keep them updated on the situation.

As I have already mentioned just keep on at them and you will get your money back or alternative GTX280 card if available.
 
Hope you get a result with this setter, I saw your thread on their forums mate, where you posted your response from XFX, so hopefully you get an equivalent card as a replacement once they talk to whoever is in charge.
 
Yep, hopefully mate as this current 8800gt isnt great at 1920x1200, still though its way ahead of the 7300gt i was running last week.
 
Actually, they just packed up their European operation and there's been a few threads lately about RMA service going to pot...

I have a m8 who sent his 8800gt for rma 2 weeks back, he got a 9800gtx+ for replacement in less than a week :confused:

Then again the ops position isn't exactly new, I bought an X-fi from them right after they came out (afew years back). When it arrived I got it out of the box, it looked like an elephant had sat on it but I tried it then rmaed it anyway.. First they sent me a etter so sarcstic I'm amazed that women never lost her job. She actually made the effort to use italics while explaining the little round things pressed to the board were capacitors that were supposed to look like 16 stone had stood on them :mad: Then they told me it wasn't faulty, then they told me I had to pay for postage back (again) and then they told me if I didn't then they'd keep the card and my money. Ultimately the time I would have lost following it through would have cost me more than the card so I just wrote it off, but I suspect that what they were hoping for.

If you ever do anything through that retailer use a CC and use the issuer to deal with any problems. Although I don't know why anyone would, that little incident is what got me to ocuk :cool:
 
Just seen there reply, just a refund not a replacement , is it still a partial refund?

They are taking you for a mug, time to get nasty! Tell em your going to trading standards and then a claims court, you have been polite enough, time to get hard with the scum.
 
Have again (politely) asked about a replacement, according to xfx they should be doing this anyway. The reps at xfx have also told me to keep them informed of any issues, (which ive done). Not offering a comparable product goes against the terms that xfx state. Its not that theyre short on stock or anything, as they have plenty of comparable products listed as in stock on the website.
 
Sadly that's true, 280/24*12=140, assuming you got a good 12 months use from it ofc.

I also assume you're being advised to push for more than 123 because, at least to me, that seems like they've taken the 140 and deducted postage/processing which really is bull.
If you've had half of 24 months you should be getting half of your money back (or however much from the time you notified them of the failure).

Small claims isn't worth the hassle of 125 pound unless you are seriously strapped for cash but even then, the difference is less than the judges hourly wage and it'd be difficult to convince him the time he even spent listening to you was worth the difference. Visit your local CAB, there you'll get a far more informed opinion than you will on these forums :)
 
The calculation for the current value of the card is extremely flawed. It seems the offer they have given is worked out by deducting 1/24th of £280 with each passing month you have the card. If it broke in the 23rd month of the warranty would they have offered you £11.67? - It's a joke! Have you asked them how they arrived at that 'current market value' figure? Ask them where it is possible to purshase a GTX280 for £123.00.

I hate the idea of living from credit (or buying what you can't afford) and as a result I've never wanted a credit card but reading this thread has made me realise I should get one for the protection on high value items. This has seriously dented my view on this scandalous retailer.

Got 11 months usage out of the card, the card started acting up over the christhmas holidays, what with the holiday period and slow postage it was a few days before they received it, then a few more to ship on again for testing. If i was gonna take the refund i can understand the valuation, what with current value of the 280 gtx. However the fact that theyre not offering a replacement, which is something they should be doing according to warranty terms.

I did read the thread for the most part, and didnt noticed that the OP had mentioned a competitor so sue me... BTW isnt it an offence to throw personal insults on this forum. Dont call me a douchbag.
