You were entirely right.
It's only a designated crossing for people, it's not a crossing at-which a button is pressed telling cars to stop.

Cars still have the right of way, it's an area for the public to cross safely, they still have to look out for cars.

If it didn't have lights to say stop, then they were totally wrong to step out.
 
I found the law for pedestrian crossings:


A Clause 11.5, Sub clause (1) of the Land Tranport (Road Users) Rule 2004, states:-
Entering crossings
A pedestrian or a rider of a mobility device or wheeled recreational device must not suddenly enter a pedestrian crossing when an approaching vehicle is so close to the pedestrian crossing that the driver of the vehicle is unable to give way to the pedestrian or the driver or rider of the device.

The question is, did you stop when applying your horn or did they stop and you not have time?

If the former, then you were in the wrong because you could stop (as long as it was not an emergency stop). If the latter you were in the right, but obviously still had plenty of time to react by beeping which you could have applied to stopping :)

Either way, you were both in the wrong, both commited criminal offences and will probably both get away with it with either your pride (him) or you wallet (you) dented so by-the-by me reading the last 5 pages and posting this has been a waste of my time. And for that I have nobody to blame but myself (although as far as i am aware that is not yet a criminal offence).

Actually this is entirely wrong.
A pedestrian crossing has right of way for the pedestrian at all times, just like a driveway across a path, with the exception listed above. A crossing with lights ?ONLY has right of way for the pedestrian when the geen man (or person, or bike, or whatever symbol the PC zealots of this world are currently using) is showing.

Fair play i would have done the same and i can sypmathise with it happening to me, people just assume that as its a pedestrain crossing they can just make a mad dash for it last minute. Ive been driving thru the town, i looked no 1 coming to crossing guy on phone changes his mind and just runs across! And u wonder why there are so many road accidents when people dont take proper precautions.

Nice one on the punch ;) Id of personally gone for the "bruce key attack" works a treat :D

also thanks for the new msn nick had to shorten it but "I had a fight in B&Q once. Some one asked if I wanted decking, so I got the first punch in and legged it" lol

Yes I'd be ****** if somebody keyed my car but I'd phone the law and use what is called insurance. What if the guy had a heart problem and went down becuase he had had an heart attack?

I dont want to fuel the fire here but...

.. you do realise in a lot of these carparks these 'crossings' arent actually legally enforcable.
We ahve these 'pedestrian areas' on site at work, or areas with crossings, and because they dont have the other requirements (just the white lines on the road) you dont HAVE to stop....

.. I was a witness to a car accident a few months back when a girl got ran over at a traffic light controlled crossing.. and when I awas re interviewed the other week I actually asked about this and the officer confirmed that crossings on trading estates/shopping parks etc etc are not actual 'official' crossings, and as such, you cross at your own risk.
 
@ the OP....big mistake IMHO.
by flattening him you've lost any chance of having the damage paid for by the guy.
you claim criminal damage against him and he will almost certainly claim common asault against you.
if money isn't too big an issue to you then you should've got out, walked over to his vehicle and key'd the hell out of it. ;)
 
If what had occured to the OP had happened to me, there's no doubt in my mind that I would have done the same. Yes the law states that I would be in the wrong in doing so, but with all the best intentions in the world, I just can't see how I would be able to refrain.

As for the various people claiming that the OP was in the wrong in the first place, do any of you actually know how to drive? The guy was already driving over the crossing when the couple ran out in front of him! He had to carry out an emergency stop (albeit from a slow speed) to avoid hitting them. How anyone can state that the couple had the right of way is beyond me.

To back this up, take a look here , specifically at:

19: Zebra crossings. Give traffic plenty of time to see you and to stop before you start to cross. Vehicles will need more time when the road is slippery. Remember that traffic does not have to stop until someone has moved onto the crossing.
 
Heh, kudos to the OP.

The one and only time I ever had something like this happen the guy tried running after me to kick my car (which I saw in the rear view mirror). Just as he went to go kick, I slammed on the brakes.

I know his dentist was VERY happy with me as the guy knocked all of his front teeth out on my tailgate after breaking his kneecap on my rear bumper!! :eek:

I got out to ask if the guy needed me to call anyone for him, but he was already crawling away whimpering.

At that exact moment the cop that had seen it all asks if I want to press charges on the guy. I giggled and said "not really, he got his own". Cop snickered and said much the same......

Much the same as the original poster. He jumped out of a row of hedges onto the carpark road causing me to panic stop. He got a good long blast of my Fiamm air horns (133db) which I guess he took offense to.

Probably took a good bit of offense to the verbal lashing he got from me, too. :p
 
You should have put it into reverse. Even if you didnt back back slowly the reversing lights going on alone would have given him a brown trouser moment :p

For some people not understanding why peope are getting so angry about cars being keyed, you need to go to the motors forum and see the threads in there, there have been 2 cars keyed with in a week and they have been keyed quite badly :mad:

Anyway,regarding the initial post. I think i would feel better getting out and hitting the guy rather than going through all the hassle of getting it paid for. I tend to take abuse personally and remain angry for ages but if i just laid into the said A-hole at the time it would probably reduce my stress levels. I gotta remember though im nearly 18 and cant go slapping daft wee pubescent retards about for being cheeky.

I was riding along the pavement to a set of lights when some lil wannabe snoop dogg with his hat to the side said "want tae watch!!" after he was passed.I then shouted back "naw you watch ya wee fat *******" but that was cool for me,no need to go slap him.

I havnt had got time to read all this, it might of all ready been mentioned. BUT imagine if that bloke had got a blood clot or something like that?

1 punch and you could have been looking at a murder charge!

There have been instances of people dying from one punch.

I admit i would have probably done the same thing as you in the heat of the moment, but its one thing to consider.
 
Sorry disagree with the hitting the guy but I can see your point of view but I don't think it was totally right.

Just an IF to add to the whole thing?

What if the woman was just recently pregnant, their first child and you almost hit him and her, hence he was angry and upset? Maybe he did run across the road and came close, maybe they didn't see you. Surely you would have seen them approaching the crossing as well. I don't think one side is at fault think both are.

I don't think hitting a guy infront of a woman and in a public place was entirely wise.

Just reading it I think both parties have anger management issues. Cyclists and pedistrians, even if you hit them and they did something stupid, I think they would still hit home on the driver. You said some other guy said it was ok and he would have done the same thing doesn't mean it was the right thing to do.

Sorry if it seems abit off-ish but I read it and can kind of relate to both sides

(Youngsters stepping out into roads and lobbing stones at my car, cars racing to beat me from crossing the road, or driving at me as I cross the road, stuff like that).
