Received 3080 physically damaged! MSI Resolved case (Lock Thread)

TBH ZX128k, after seeing more and more as more time passes, broke, and more people receiving them broke, it tells me mine wasn't a one off, or some sort of freak accident, it is in it's nature, a very bad design, extremely weak, and breaks as you said by the slightest force, even that of pulling it out from the anti static bag. With this there is no way I want an MSI Gaming X Trio 3080 of any sort, even undamaged, the fact it's weak, you could remove it 1 day and it breaks, hell you could even blow a bloody canned air over it and it would actually break!! Completely unacceptable, so no way do I want one, I would like to RMA this damaged card for a different one, but as you said with overclockers putting me back of the queue, through no fault of my own, i won't even see one now till well into 2021.

All the cards coming into OC'ers at the moment are most likely already bought by other customers legally. This means a wait for a replacement because of lack of stock. Replacements coming out of available inventory which is zero at the moment. I blame NVidia for the stock issues.
 
um, I bought my card "LEGALLY" also way before most of them, so why through no fault of my own, receiving a damaged and not fit for purpose product, damaged or not should I now have to wait till next year due to MSI's shoddy product.

Inventory is only allocated as it arrives, not beforehand anyway, so that's not the case.
Anywhere else, if there is an RMA they would simply take priority of next incoming stock, pretty much standard.

No one should be waiting. Some people have been waiting for a card for well over 30 days. When you buy a product online it should be promptly delivered within 30 days. Overclockers appears to be getting very low volumes of cards and can only deliver what they receive. This is why people have a right to cancel after 30 days. The card I bought has had very few delivered to overclockers. So my choice is wait in line or cancel.

If the product is damaged then you could RMA it. Fit for purpose would require it to be no longer working. I believe the card still works. I would guess there are zero cards in stock at the moment and until overclockers clears its back log, there wont be for some time. So you will have to join the queue again at the end if you return for replacement. Note things are so screwed, even if you return the product for refund. If it was damage in transit. You still join the back of the queue, reguardless of where you try to get a 3080 from.

In this case thanks to stock issues, its hard to get replacements in a timely matter. Its hard to even get a card in the first place.

Sending the goods back
Unless you have bought the goods under a distance selling contract, you won’t have any legal right to send the goods back if you have simply changed your mind. You should refer to that retailer’s return policy and will probably have to pay postage. If the goods have arrived damaged, and you have been offered requested a repair or a replacement, you should not have to pay any further sums of money in this respect. This includes labour, materials or postage. The repair / replacement should take place in ‘reasonable time’ and you should not experience any ‘significant inconvenience’, while you are without it/them. In all respects, you will have greater rights if you had bought them under a distance contract (online, mail order). This is because you didn’t have the opportunity to examine them before they were shipped – to see if they are:

  • Of satisfactory quality
  • As described

  • Appropriate to your requirements
With this in mind you will have a 7-day cooling off period, during which time you can cancel the contract and get your money back in full (including delivery charges). Unless otherwise specified (for certain types of products), you should be able to send the items back for free, and not incur any additional charges such as a restocking or admin fee. Although many retailers will request products to be returned in a saleable condition in their original packaging, they cannot make it a condition of giving you a refund. Didn't you follow up with the guy offering the cash & card trade ? Take that, it sounds like a good option.

This is still an option of course, but I would much prefer to have a 3080 over making profit.

Clearly overclockers are not going to help me with this so of i dont sell to the guy looks like I just got a keep it and maybe get a custom backplate in the future sometime.

I love how these companies try and save pinch every penny they can ..and ends up biting em in the backside. Its an headache for the company cost and rep and more so the paying customer having to deal with it all..

The question is why the penny pinching are Nvidia really charging them sky high for the chips / licence ect?
 
If I do make a decision to go for AMD card, I will sleep on it this weekend, probably better getting the 900 from that offer and using that to buy an AMD card, plus I'll have a 1070 to sell to, or could even put into my sons machine.

According to Gamers nexus, nvidia has set an unrealistically low msrp (apparently) to AIB's and they are struggling to hit it without rebates, or something a long those lines...Perhaps why they are cost cutting.

Probably was the case in the beginning, but the prices being charged at the moment are nowhere near msrp.

Oh yeah the current prices are a joke, they are way way above msrp now. I meant the actual msrp was apparently impossible to hit without nvidia selling the chips/memory cheaper, or upping the msrp.
 
just get it silver soldered back on/bit of araldite etc if you care that much. It's only a graphics card. If it works why care? Seriously these things only could a few hundred quid.
 
If I have got this all right, if you want a replacement you have to wait in line. If you dont want to wait in line then its a refund. Then you have to wait in line for another card. Most likely AMD cards being good as they are, will get a lot of people jumping ship to get an AMD cards because they cant get a nvidia card. You could end up in the AMD queue instead. Then you have an option to sell the card to someone else who would accept the damage and pay you extra. Sounds good but you still have to wait in some queue for another card. Every one of these positions sounds suboptimal.

I blame nvidia, understand covid-19 is wtf and dont like the whole stock issues personally but have no choice but to wait in line like everyone else. So long as overclockers are honestly trying to fulfill the orders, then what can we do. I can wait here in line or wait inline for some other company. No one has stock.

If they dont have the stock to replace in a timely enough matter for you not to be put out, then it can only be a refund and another long wait in line.

It sucks from every angle.

If I get a card I am doing nothing to it until stock issue improve. No watercooling, overclocking or anything.

You could live with the damage if the card works or as you stated get an AMD card. The good news is this has been refered to customer service in the title. Maybe you can get a replacement and someone can buy your card as b grade.
 
You forget one vital fact in all that, !! I have already waited my time in line since release day !!

You speak like I got to wait like everybody else, that's right I do, thing is I already have waited in line, waited longest time possible, which is since time of release.
