Not quite that simple sadly. There is an obligation for moderation and I believe court precedents have been set for this, though I am not in anyway a legal expert on such things.

There is no obligation to moderation - the only way it could be illegal is if similar threads about other companies are moderated but the one about this particular company is allowed to stand.
Since OCUK does not do that with respect to car companies it's all fine

As I say I am not a legal bod so can only use other references I have seen, well outside my area of knowledge.
 
I'm truly amazed all the other forum owners have given in to Thorne's tactics. Anyone with an ounce of legal knowledge could see right through his tactics.

Not surprisingly we haven't heard from him since. If we do we are ready to deal with the consequences but I don't think for 1 second it will happen.

Besides, as I posted above the UK law says that forums fall under slander and not libel due to it being classed as a conversation and it would only be classed as libel if it was being posted by someone employed by the company running the forums
 
i genuinely dont understand all this legal stuff.

If this forum hosts content that contains something that is in any way not 100 % accurate, how can OcUK not be sued for libel if he can claim it looses him business ?

Nor me but as someone else pointed out, there is no actual post here, just a link back elsewhere; Google provides links too...
 
As someone who works in the motor trade I really cannot understand what must go through these "Tuners" heads, why do such a half hearted job? Do they do it on purpose? I really cannot imagine anyone doing the level of work displayed on that CSL and thinking to themselves "Yup. I've done a good job there".

Tuning/Engineering is something that I'd love to get into, but if THAT is the accepted level of work within these companies then I think I'll pass...

As for his old posts, I don't really see the problem. Just a few years ago I was completely clueless about the inner workings of a car and asked some dumb questions on Forums, now my knowledge has improved a fair bit, but I'm sure I'll look back in a few years at my old posts and think that I was clueless at this point too. It is all about racking up experience :).

But you haven't started 'Joshy Motorsports' and charged customers tens of thousands of pounds for huge amounts of work.

But what if I do decide to do something like that in the future when I do have the relevant experience and expertise? Will my n00b posts made several years before count against me?

Only if you provide a questionable service, make no attempt to sell yourself as a professional with decent customer service, and threaten innocent 3rd parties with legal action because you have no PR skills.

Exactly, "relevant experience and expertise" which is something he appears not to have.
 
There are a few simple rules he seems to have forgotten:

Know your business; know what you are capable of as a business and what is beyond you and don't risk your customers money unless they are 200% behind you. He has simply run out of talent and hasn't had the pills to put his hands up and compensate the owners then go back to doing what he knows and what they are capable of.
